Proposition 132 – Increase Penalties for Fentanyl Crimes

Fentanyl is a synthetic opioid and is responsible for more overdose deaths in Colorado than any other drug.

Currently, Colorado has tiered felony penalties based on the quantity of fentanyl distributed, allows for reduced penalties in certain cases, and possession of small amounts of fentanyl without a prescription is a misdemeanor.

Prop 132 mandates 8 to 32 years in prison for distribution of any quantity of fentanyl and makes possession of any quantity of fentanyl a felony.

Recommendation: No

Judicial discretion would be practically eliminated for illegal possession or distribution of fentanyl, a drug which is legal when prescribed by a doctor. This ballot measure introduces too many possibilities for faulty sentencing.
